Published in February of this year, the College Art Association's Code of Best Practices in Fair Use for the Visual Arts is an essential resource for those who make use of images in scholarly and creative work. The Code describes situations when a "fair use" argument may apply as an exception to copyright. Specifically, it addresses the question of whether fair use applies in contexts of Analytic Writing, Teaching about Art, Making Art, Museum Uses, and Online Access to Archival and Special Collections.
